These Terms & Conditions govern the purchase and use of the Empowerly Monthly Membership, a recurring monthly subscription that gives access to digital lifestyle content and tools. Empowerly is a sole proprietorship registered in the Netherlands. Business address: Kanaalmuur 17, 3991 VT Houten, Netherlands. Chamber of Commerce (KvK): 42168393. VAT ID: NL005552162B68. Contact: fit@empowerly.nl. These terms apply alongside mandatory consumer protections, which always prevail.
Empowerly offers general lifestyle resources such as recipes, meal planning, grocery lists, workouts, challenges, habit tracking and progress tools. Features and content may evolve. We will not materially reduce agreed functionality without observing applicable consumer rights and notification requirements. The service is provided digitally through an online account; it is not personal medical care or individual coaching.
Empowerly currently offers one membership: the Empowerly Monthly Membership. The price for new members is EUR 19.95 per month, including 21% Dutch VAT. The price applicable to your order is shown before purchase and confirmed in your order confirmation. Existing members keep the subscription price agreed at the time of their purchase; a change to the price offered to new members does not change an existing member's agreed price.
Payment is handled by Plug&Pay and its payment service providers. The first monthly payment is due when you place your order. The membership renews automatically each month, and the agreed monthly price is charged at the start of each new monthly period until the membership ends.
If a renewal payment fails, we may send you payment reminders and you will have at least 7 days from the due date to complete the payment. Where permitted by applicable law, Empowerly may temporarily suspend access for an unpaid subscription; access is restored once the outstanding payment has been received. Any collection costs will only be charged in accordance with applicable Dutch consumer protection rules. We will provide legally required information about any price change affecting an existing membership before it takes effect.
To use the membership, you must create or sign in to an account using accurate details. Please use the same email address for your account as for your purchase, so that your payment can be linked to your account. You receive access immediately after successful payment and verification of your account. Keep your credentials secure; do not share your account or interfere with platform security. If access is not activated, contact fit@empowerly.nl. We will address any failure to provide the contracted digital service in accordance with applicable law.
The Empowerly Monthly Membership continues for an indefinite period and automatically renews each month until cancelled.
You may cancel your membership at any time without an additional notice period by emailing fit@empowerly.nl or using the Request cancellation option in My Account, which prepares an email for you.
Your cancellation is effective according to the date your request is received and the applicable subscription terms, not the date on which Empowerly manually processes your request. We will confirm the effective cancellation date by email.
No further payments will be charged for billing periods after the effective cancellation date. Access continues until the end of the period already paid for, unless applicable law requires otherwise.
If a renewal payment is collected because Empowerly processes a timely cancellation too late, that payment will be refunded in full.
Cancellation is separate from exercising your statutory right of withdrawal.
If you are a consumer entering into this agreement at a distance, you have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period begins on the day the contract is concluded.
You can exercise your right of withdrawal by sending an unequivocal statement to fit@empowerly.nl or by using the online withdrawal function available on our website.
The model withdrawal form at the end of these Terms & Conditions is optional.
To meet the withdrawal deadline, it is sufficient to send your withdrawal notice before the applicable withdrawal period expires.
Accessing or using your Empowerly Membership does not, by itself, remove your right of withdrawal under these terms.
Any mandatory statutory consumer rights remain fully applicable.
If you validly withdraw from your Empowerly Monthly Membership within the applicable 14-day withdrawal period, your membership agreement will end.
Empowerly will refund all payments received under the membership agreement during that withdrawal period, even if you have already accessed or used the membership.
No deductions will be made for accessing or using the membership during the withdrawal period.
We will issue the refund without undue delay and no later than 14 days after receiving your withdrawal notice.
The refund will be made using the original payment method unless you expressly agree otherwise. No additional refund fees will be charged.
No further subscription payments will be due after the agreement has been validly withdrawn.
This refund policy does not limit any additional mandatory consumer rights.
Refunds outside the statutory right of withdrawal and the situation described in article 06 are assessed against the individual agreement and applicable law. Nothing in these terms restricts your remedies if the digital service does not conform to the agreement.
All nutrition, fitness and lifestyle information is general educational material, not a medical diagnosis, treatment plan or substitute for professional healthcare advice. Exercise and dietary choices should be appropriate for your individual circumstances. Seek qualified advice where necessary and stop an activity if you experience concerning symptoms. Results vary; no particular health, weight or fitness outcome is guaranteed. This disclaimer does not limit rights or liability that cannot lawfully be excluded.
We handle personal data in accordance with applicable data protection law and the Empowerly Privacy Policy. Habit names and other optional free-text fields should not contain medical diagnoses, medication details or other sensitive health information. Do not upload information about other people without a lawful basis. You may contact fit@empowerly.nl to exercise applicable privacy rights.
Original platform content, design and branding are owned or licensed by Empowerly. While your membership is active, you receive a personal, non-transferable, non-exclusive right to access the service for your own non-commercial use. Do not resell, systematically copy, publicly redistribute or provide unauthorized access to membership materials, except as allowed by mandatory law.
We aim to keep the service reasonably available and secure, although maintenance and technical interruptions may occur. We may provide updates needed to maintain functionality and security. Changes to digital services will be made in compliance with applicable conformity, notification and termination rights. Please contact us if the service is unavailable or does not conform to the agreement.
You can send questions or complaints to fit@empowerly.nl, stating the email address used for your purchase and a description of the issue. We aim to provide a substantive response within 5 business days. You retain all statutory remedies, including those relating to conformity of digital services and any applicable dispute resolution or court procedures.
Empowerly remains liable where required by law. We do not promise particular individual lifestyle results. Nothing in these terms excludes or restricts liability for intentional misconduct, mandatory statutory remedies, or any other liability that cannot lawfully be limited. Any permitted limitation is applied only to the extent fair and lawful in the circumstances.
These Terms & Conditions are available on our website before you place your order and will be provided to you on a durable medium after your purchase. The version provided at the time of purchase forms part of your agreement. We may update these terms for future purchases. Changes to existing memberships will be made only where contractually and legally permitted, with appropriate prior notice and with your right to cancel if you do not accept a change.
Dutch law governs these terms, without depriving consumers habitually resident elsewhere of mandatory protections applicable to them. Courts have jurisdiction as determined by applicable law; no mandatory consumer forum rights are excluded.
